DUI manslaughter charges are expected to be filed Wednesday afternoon against Cleveland Browns wide receiver Donte' Stallworth, alleging the football player was driving drunk last month when he struck and killed a pedestrian on Miami Beach, according to a source with knowledge of the investigation.
Blood tests revealed Stallworth had a blood alcohol level of .12 after the 7 a.m. crash, a second source with knowledge of the investigation told The Miami Herald

Cleveland may be in the market for a wr.

Still interesting to see how this plays out in the legal forum. Stallworth was "legally intoxicated", and the guy he hit and killed was apparently jaywalking.

J-walking sure, but the pedestrian always has the right-of-way. If he wasn't under the influence he might have a case. .12 = Guilty As Charged :cage:

FYI Stallworth WAS arraigned yesterday on DUI Manslaughter. Why this is significant is that if found guilty...this charge comes with a minimum sentance of 4 years in prison, as opposed to a DUI charge which can be pled out.

Net, Stallworth's value is now seriously at risk...as once trial begins....he potentially could be in jail for 4-15 years if found guilty.

There is a possible defense even with his intoxication if the pedestrian's negligence caused the accident. If I remember correctly the guy ran out into traffic and Stallworth reacted by flashing his lights. I could see an objective jury going either way on that.

From what little I have seen this morning he might be pleading guilty as charged with a reduced jail sentence.

.

I don't understand how Stallworth had time to flash his lights at this guy, but couldn't avoid running him over. I wouldn't be surprised if that is total BS, created by Stallworth.

I don't understand why it is difficult to imagine someones hand reflexes being faster than their foot. I wouldn't be surprised either way but if I recall correctly the reporting was pretty much unanimous that the guy ran into traffic.

Read that Stallworth has reached a settlement with the victim's family which should weight in his favor to some extent.

Okay, yes the guy was J-Walking. IT was early in the morning and he was rushing to meet a bus.

that however does NOT excuse this idiot for being behind the wheel drunk. No way, no how. The fact this guy may get off with a hand slap absolutely sickens me. I can see NO reason for you to defend him either.

What did he plead to? I thought the manslaughter had a minimum so I take it there was a reduction to a misdemeanor? If so I don't think it should be much of a surprise.

Vick was possibly over sentenced but an accident that was not clearly Stallworth's fault is not something I would get worked up about especially since I would imagine the settlement with the guys family probably played a huge role. Not just by compensating them but also obtaining their agreement not to question the plea agreement.
