The 5th circuit court of appeals has ruled against Elliott, and his suspension has been reinstated, Ian Rapoport of NFL Network reports.
It's not immediately clear what this means for Elliott, but it appears he will be serving a suspension at some point. Expect Elliott's status to be updated as more details become available.

So they had a great legal discussion on ESPN radio this morning, and basically he is screwed.

Per the legal source he has the following options:
1) he could refile in Texas as the original finding was dismissed due to the technicality that he filed prior to the whole appeal process in NFL was complete. The issue there was though, that getting a judge to revisit a case that was thrown out by an appellet court already is very, very hard.
2) go to NY and file there, but issue there is NFL has had great success there and has the Brady decision already in pocket there - so chances are not good he would win.
3) appeal to Surpreme court- but very unlikely he would get a stay while they decided if they would hear the case, so he would miss the 6 games anyway and most feel the S.C. would not hear it, as it was collectively bargained.

Net, starting week 7 the expectation is Zeke be out for 6 weeks.

It would appear that Ezekiel Elliott is going to remain suspended for the next six games, as an injunction that was previously allowing the Dallas Cowboys running back to play has been lifted.

Elliott had previously been granted an injunction that blocked his six-game suspension, but judges from the 5th circuit ruled in the NFL’s favor last Thursday, citing a procedural issue with the way the NFLPA handled the case. Elliott’s camp responded by filing a petition for a rehearing, but the decision was upheld on Tuesday (today).


Without getting into too much legal jargon, the bottom line is that Elliott’s goose is basically cooked. There are still some legal avenues his attorneys and the NFLPA can explore, but the most likely outcome is that Elliott misses the next six games.

As best as I can understand and that is very well there's still a NY court that could save his bacon though it is considered unlikely. The Texas court is expected to drop out after this latest ruling at noon and there's always the USSC which is unlikely to take the case. So we still wait, maybe, I think.

The only reason to appeal it to the Supreme Court which everyone knows they would deny anyway because it was collectively bargained what do you to delay the suspension as long as possible

It's not over but we have a tiny bit of clarity for Ezekiel Elloitt. He was granted a Temporary Restraining Order (TRO) today.

From NFL.com's Ian Rapoport: "RB Zeke Elliott got his TRO from the Southern District Court. The suspension is stayed for 14 days or until further proceedings."

From ESPN's Field Yates: "Part of what this means: Cowboys RB Ezekiel Elliott can play this Sunday vs. the 49ers."

This is not over and the future isn't clear for Elliott, but what we do know is he should be on the field this week. Stay tuned.

Before Zeke owners get all excited...if this just pushes it back a few weeks you are now talking playoffs....sucks....at least if it started this week he would be ready to go by fantasy playoffs...my guess is now we will be looking at a playoff suspension.

Elliott's restraining order allows him to play Sunday, but expires after 14 days. The league wants a decision to be made before next week's game against Washington. Elliott is also waiting for a decision on his reheaing with the Fifth Circuit Court of Appeals, putting his post-Week 7 status completely up in the air.

Yeah, the NFL is not backing down even a little here, so they must be supremely confident that they will win this legal battle.

FF players probably wish he would just start serving his suspension so he will be back by week 14.

So to catch folks up, The court has denied Elliot's request to delay the suspension, so as of now he IS suspended. However, the court did give him 24 hrs to appeal, no idea if that appeal has happened.

Seriously, Dallas has to at some point Eat the suspension. He has time to take it now, and get up to full speed for playoffs if they still make it.

He's back!



The Second Circuit Court has granted Ezekiel Elliott a temporary stay of his suspension, and he is eligible to play Week 9 against the Chiefs.
