Ok...mistake #1 is a Longhorn football player being in College Station to begin with. Aggies are as ignornant as they come. I cant tell you how many people I know who have drove over there and had their vehicles vandalized for having a UT sticker on it....
For clarification: The criminal trespass warning cant apply to the entire complex unless authorized by management, who must be personally present to issue the warning. In other words, once he left the apartment he had complied. Even then, it only applies to the grounds and buildings, NOT the parking area, unless it is gated access, which by the satellite photos off Google Maps it is not. They cant tell him to leave what is considered a public parking area.
As for the second charge, yes it is illegal to resist an arrest, even if the arrest is not lawful, but I dont know any DA that prosecutes "passive resistance". Great fluff job by CSPD on this one, but I dont think the charges will stick.
That being said, these guys have gotten a bit loose around here, and I think it is time to draw the line. You get arrested, your off the team. We arent USC for God sakes.
